Terms of Service

By engaging with LeadSpark Marketing ("LeadSpark," "we," or "us"), you agree to these Terms of Service. These terms govern our managed website plans, optional add-ons, and separately scoped custom projects.
1. Scope of Service
LeadSpark provides managed websites, local visibility services, lead-response automation, phone-answering systems, and custom technical projects. The specific services included in your engagement are described on the applicable plan page, order, or written proposal.
2. Engagement and Billing
- Managed Website Plans: Website plans have $0 setup fees and are billed month to month at the selected rate. The monthly fee covers the website build, hosting, security, and ongoing updates described for that plan.
- Productized Add-ons: Optional monthly services may be added or removed independently of a website plan, subject to the billing cycle shown at signup.
- Custom Project Work: Larger or bespoke builds begin with a system audit and are separately scoped and quoted. Any deposit, milestone, or payment terms will appear in a written proposal.
3. Ownership and Sovereignty
Your Business Assets: You retain ownership of your domain, leads, customer lists, supplied content, and business data.
Managed Systems: The managed website, hosting, and service infrastructure remain available while the related monthly plan is active. Ownership and licensing for custom project work are governed by the applicable written proposal.
4. Performance and Liability
We build high-performance systems designed for growth. However, LeadSpark Marketing is not responsible for business success or failure, nor are we liable for any loss of revenue, data, or profit resulting from standard technical maintenance, API outages from third-party vendors (like Google or other integrated services), or general market conditions.
5. Managed Evolution
Technology moves fast. LeadSpark manages necessary updates, security patches, and server migrations for active managed services. You agree to allow reasonable technical maintenance needed to preserve their integrity and performance.
6. Termination
Managed website plans and monthly add-ons may be canceled at any time without an exit fee. Service remains active through the end of the paid billing cycle, then the managed website or add-on will be disabled unless a separate migration arrangement is made. Your domain and business data remain yours. Custom projects follow the cancellation terms in their written proposal.
7. Governing Law
These terms are governed by the laws of the State of Texas. Disputes shall be resolved in the jurisdiction of Collin County, Texas.
